If you win, the "fee-shifting" rule in English law allows your
solicitor to claim your costs (including his fees, counsel's fees, and
disbursements) from your opponent. And, since April 2000, The Access
to Justice Act 1999 also allows him to claim his "success fee" from the loser -
this means that provided the solicitor is competent and able to work
efficiently, all of his (or her) costs are met, and he no longer has to take
a percentage of your compensation as part of his fees.
2. But what
happens in the unlikely event that the claim is unsuccessful? With Accident Claims Direct, you do not have to pay even if you lose. This is because we
are able to secure "After-the-Event" insurance to protect
you against costs should you lose. Therefore,

solicitor normally enters
into a Law Society's Conditional Fee Agreement
with
you - unless you already have some form of funding arrangements. This
agreement sets out the
basis for him to claim his costs from the party responsible for your
