Accident Claims - The Motor Insurance Bureau


If the person responsible for your accident was uninsured, your solicitor would direct the claim at  the The Motor Insurance Bureau (MIB).  This also applies to a negligent untraced driver.

 

The Motor Insurance Bureau (MIB) is the organisation set up to compensate the victims of negligent uninsured and negligent untraced motorists. The Road Traffic Act 1988, requires every insurance company to be a member of the MIB and to contribute to its funding.

The MIB's raison d'etre is to compensate the victims of uninsured or untraced drivers quickly and fairly within the terms of its agreements and the law.

 

There are two different schemes administered by the MIB: 

The Untraced Drivers Agreement

This is the agreement under which the Motor Insurance Bureau compensates victims of negligent untraced motorists. The MIB will make an award for compensation in respect of personal injuries only. The applicant must have reported the accident to the police within 14 days or as soon as reasonably possible. Applications will only be considered if they are received within three years of the accident. Following detailed investigations by the MIB an offer of an award will be made to those eligible for compensation and if rejected as being inadequate there is a right of appeal to an independent Arbitrator whose decision will be final and binding.

 

The Uninsured Drivers Agreement

This is the agreement under which Motor Insurance Bureau compensates the victims of negligent motorists whose vehicles are uninsured.
