Newman v Horwood

Frederick Evan Newman, who was left in a ‘minimally responsive state’ by head injuries suffered in a road smash in Dorset today
was awarded more than £1.3 million in damages at London's High Court.
He suffered catastrophic injuries when a car in which he was a rear-seat passenger hit a tree on 28 December 28 1996.
A severe, traumatic brain injury has left Mr Newman, now aged 40, in need of institutional care for the rest of his life.
He was in a coma for eight weeks and, although he can hear and is aware of the world around him, he can communicate only by simple hand movements to express ‘yes’ or ‘no’.
Mr Newman sued the driver of the crashed car - David Martin Horwood – whose motor insurers did not dispute liability for the accident.
Mr Justice Owen said he was ‘entirely satisfied’ with the settlement which he approved.
